Immigration Requirements for People Travelling to Canada

Foreign nationals, including US citizens, are restricted from entering Canada without a visa. Visa requirements vary among countries, but all must be met in order to enter the country. You should apply for your own visa, if you plan to travel to Canada. Many tourists overstay their visiting or validity periods by crossing the border illegally. This is a serious criminal offence and can result in fines and even jail time.

There are many reasons why people travel to Canada. Some do so to study – whether at a university, college or university in Canada or in the USA. Others take part in athletic competitions. Still others visit family or friends who are not Canadian. However, even if a visitor is entering Canada for a non-discretionary purpose – such as studying or work – they may still be subject to some form of immigration restrictions.

There are three types of immigration restrictions applicable to all Canadians regardless of their country of birth. First is the Federal Skilled Worker Program. Applicants can apply to enter Canada as a worker if they meet the general qualifications. In order to qualify, the applicant must have been hired for a position that can be performed by a Canadian citizen and have been working in Canada for at least two years. The eligible person will be issued a certificate of entry.

A second type of restriction affectsCanadians travelling to another country. While a visitor who becomes a permanent resident of that country can work in Canada, they must quarantine themselves from the contagious disease that is carried by mosquitoes in Canada. Anyone travelling to another country must carry a special health insurance card that contains a copy of their immunization records. Anyone traveling to Canada that does not have such insurance is required to get one from the local tuberculosis hospital.

A third related restriction affectsCanadians travelling to other foreign nationals or to countries of the European Union. If an immigrant to Canada has acquired HIV then they must remain quarantined in the country for twelve months after becoming infected with the virus. Anyone who becomes ill with HIV in their country of residence cannot travel to Canada to take advantage of a better life opportunity in another country. Anyone who travels to a province that has not implemented the necessary medical treatment for HIV will also be refused entry to Canada. The applicant will need to get special approval from the IRSA before they are allowed to travel to Canada.

The third type of travel restrictions that affectsCanadians going to Canada are imposed by the Indian Act. The first thing that you should do when planning a trip to Canada is to make sure that you are heading to a Canadian province. The first portion of the Indian Act states that anyone coming to Canada to work, study or make an application for citizenship must first register in the Indian Status Card office. Anyone who cannot present valid proof of citizenship will be considered an illegal immigrant and subject to all the same immigration restrictions as other immigrants.

Finally, anyone who plans to travel to Canada should also consider the points system which is a points based system that awards visitors points based on their financial ability. Anyone coming to Canada with fewer than fifty points will be eligible for a visa. Visas will be granted quicker if the applicant is coming to visit family members. However, it can take many years to get to the point where you are eligible for a visa. For this reason, it is important that you carefully review your financial circumstances and decide if you require financial support from your immediate family members while you are planning to travel to Canada.

The three Immigration rules (temporary residence, immigration and Canadian citizenship) only apply to people who are legally present in their originating country. Individuals who are travelling to Canada are not covered by the Indian Act and should obtain an authorized visitor visa prior to travel. There are several agencies throughout India that provide support and information on how to get an immigrant visa. These agencies can offer information on the application process, types of documents needed and any rules or regulations related to immigration that you need to be aware of. If you are unable to find the information you need or if you have questions about the Indian Act, you should contact an accredited Canadian visa office.
